                   	     ORDINANCE NO. 9754
                  
                  
                   AN ORDINANCE CLOSING AND ABANDONING UNNAMED
                   STREETS LOCATED SOUTHWEST FROM SHALLOWFORD
                   ROAD, AND SOUTHEAST FROM GUNBARREL ROAD, MORE
                   PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN
                   CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned unnamed streets located southwest from 
Shallowford
         Road, and southeast from Gunbarrel Road, more particularly
         described herein, and as shown on plat attached hereto and made 
a
         part hereof by reference:
                  
                   A 25 foot wide and two 40 foot wide unnamed and
                   unopened streets beginning on the southeast
                   line of Gunbarrel Road 1279.7 feet southwest of
                   the intersection of the southeast line of
                   Gunbarrel Road with the southwest line of
                   Shallowford Road, as both streets were
                   originally dedicated on the plat of Brookshire
                   Subdivision, as shown by plat of record in plat
                   book 12, page 39, R.O.H.C., said point being
                   the southwest corner of block 3, said
                   Brookshire Subdivision, thence southeast 1278.5
                   feet with the southwest line of blocks 3, 4, 5,
                   and 6, to the southeast corner of block 6,
                   thence northeast 645.1 feet with the southeast
                   line of block 6 to the northeast corner
                   thereof, thence northwest 118.5 feet with the
                   northeast line of block 6, thence at a right
                   angle northeast 40 feet to the southwest line
                   of block 15, thence southeast 118.5 feet with
                   the southwest line of block 15 to the southeast
                   corner thereof, thence northeast 600 feet with
                   the southeast line of block 15 to the southwest
                   line of Shallowford Road (as originally
                   dedicated), thence southeast 40 feet with
                   Shallowford Road to the northwest corner of
                   block 14, said Brookshire Subdivision, thence
                   southwest 600 feet with the northwest line of
                   block 14 to the southwest corner thereof,
                   thence southeast some 17.5 feet with the
                   southwest line of block 14, thence at a right
                   angle southwest 40 feet to the northeast line
                   of block 7, thence northwest some 17.5 feet
                   with the northeast line of block 7 to the
                   northwest corner thereof, thence southwest
                   645.1 feet with the northwest line of block 7
                   to the southwest corner thereof, thence
                   southeast some 17.5 feet with the southwest
                   line of block 7, thence at a right angle
                   southwest 25 feet, thence northwest some 1336
                   feet parallel to the southwest line of blocks
                   7, 6, 5, 4, and 3, to the southeast line of
                   Gunbarrel Road (as originally dedicated),
                   thence northeast 25 feet with Gunbarrel Road to
                   the southwest corner of block 3, the point of
                   beginning.  Tax Map No. 149H-F-1, 1.1, and 8.
                  
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:
                  
                   1.  The staff of the Planning Commission
                       recommends resubdivision of lots.
                  
                   2.  Reservation of an easement the width of the
                       right-of-way for South Central Bell for the
                       purpose of operating and maintaining its
                       facilities in said right-of-way.
                  
                   3.  The reservation for the Tennessee-American
                       Water Company of an easement the width of
                       the right-of-way for the purpose of
                       operating and maintaining their facilities
                       located within the right-of-way.
                  
                   4.  The areas reserved for utility easements
                       must be kept free and clear of all
                       structures.
                  
                   5.  All existing easements are retained.
                  
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
